Terms and Conditions

CartaDigitalizada terms of use: digital menu, plans, time clock, community, Stripe payments, cancellation and liabilities.

1. Acceptance

By registering for or using CartaDigitalizada (web, dashboard, public menu, time clock, community or other modules) you accept these terms and the privacy policy. If you do not agree, do not use the service.

2. Service description

CartaDigitalizada is a SaaS platform for hospitality and businesses that includes, depending on the product and plan contracted:

  • Digital menu / QR menu: creation and publication of online menus, templates, PDF, QR, customisation, multilingual support, statistics, bookings and other features described on the website according to plan (Free, Basic, Premium or current offers).
  • Time clock (Fichaje): a separate module to record working time with geofence and employee management, aimed at facilitating compliance with working-time recording obligations; responsibility for regulatory compliance rests with the user company.
  • Community: a space for menu venues to publish content and connect with other venues.
  • Resources / demos / Enterprise: informational content, demos and custom projects (custom web/menu) under commercial agreement.

3. Accounts

  • You must provide accurate information and keep your credentials confidential.
  • You may register for digital menu or for time clock according to available flows; products may have specific dashboards and terms of use.
  • You are responsible for the content you publish (menu, community, employee/diner data you enter) and for having rights and legal bases to process them.
  • For multiple sites or Enterprise needs, contact us; the scope is defined contract by contract.

4. Plans, prices and payments

  • Current prices are shown on the website (e.g. Free plan 0€/month, Basic 4,99€/month, Premium 9,99€/month; time clock from 11,99€/year; Enterprise with indicative development and maintenance amounts). Annual prices or one-off offers may exist.
  • Amounts are shown in euros. Applicable taxes (e.g. VAT) will be determined and shown at Stripe checkout according to current rules and tax configuration.
  • Recurring and one-off charges are processed via Stripe. We do not store full card details on our servers.
  • No lock-in on standard subscription plans: you may cancel from the dashboard/billing portal; paid access continues until the end of the period already paid, unless otherwise agreed.
  • Except where required by law or written agreement, there is no refund for partial periods already started nor for Enterprise deposits/projects already performed for the agreed proportional part.
  • Enterprise and custom work are governed by the specific quote or contract (development payment, monthly maintenance, deliverables and deadlines).

5. Time clock and labour compliance

The time-clock module is a technological assistance tool. The user company is solely responsible for complying with applicable labour law (including working-time recording rules), informing its staff and the accuracy of clock records. CartaDigitalizada does not provide labour law advice.

6. Community and user content

If you post in the community, you grant us a non-exclusive licence to host and display that content in the service. Illegal, defamatory content, content that infringes third-party rights or that abuses the platform is prohibited. We may moderate or remove posts and suspend accounts for breaches.

7. Bookings and third-party data

If you enable bookings or other diner data capture, you are responsible for informing them and processing those data in accordance with the GDPR. You will use the feature only to manage bookings for your business. Confirmation/rejection emails are part of the technical service.

8. Acceptable use

The following, among other conduct, is prohibited:

  • Publishing illegal, misleading, offensive content or content that infringes third-party rights.
  • Attempting to access other people's accounts, data or systems; breaching security; or performing unauthorised reverse engineering.
  • Using the service for spam, unlawful data harvesting or abusively overloading the infrastructure.
  • Impersonating identities or fraudulently falsifying business information.

9. Intellectual property

The platform (code, design, CartaDigitalizada brand and our materials) is ours or our licensors'. Your menu content, images and texts remain yours; you grant us a limited licence to host, display and back them up while you use the service (including the public menu and, if applicable, the community).

10. Availability and limitation of liability

We work to keep the service available, but we do not guarantee uninterrupted availability or a complete absence of errors. To the extent permitted by law, we are not liable for lost profits, loss of data exportable by the customer or indirect damages arising from interruptions, misuse or business decisions based on statistics.

Nothing in these terms limits mandatory consumer rights where they apply.

11. Cancellation and account deletion

You may cancel paid subscriptions and request deletion of your account. Closure involves cancelling Stripe charges where applicable and deleting associated local data according to the privacy policy. We reserve the right to suspend or cancel accounts that breach these terms or pose a risk to the service or other users.

12. Modifications

We may update these terms. The update date indicates the current version. Continued use after notice of material changes constitutes acceptance. If you do not agree, you must stop using the service and, where appropriate, delete your account.

13. Governing law and contact
